Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Herniel CoS (the “Service”), operated by ZIKLAG HOLDINGS, LLC (“we,” “us,” or “our”) under its Hapibit brand, available at herniel.hapibit.com. By accessing or using the Service you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business, and “you” includes that business.

2. The Service

Herniel CoS lets authorized business users connect their Facebook Page and Instagram professional account and publish organic content to that account — currently single-photo feed posts, with additional formats and scheduling planned. The Service is provided as a private beta and features may change.

3. Accounts and Meta platform

You sign in with Facebook Login and grant the Service the Meta permissions described in our Privacy Policy. You are responsible for the accounts you connect, for having the rights to manage them, and for complying with Meta’s applicable terms, including the Meta Platform Terms, Facebook Community Standards, and Instagram Community Guidelines. You can revoke the Service’s access at any time in your Facebook settings.

4. Your content

You retain all rights to the content you publish through the Service. You grant us only the limited rights needed to operate the Service — transmitting your images, captions, and instructions to Meta’s APIs on your behalf. You are solely responsible for the content you publish and for having the necessary rights to it.

5. Acceptable use

You agree not to use the Service to:

• publish content that is unlawful, infringing, or deceptive;
• violate Meta’s terms or policies, including spam or platform manipulation;
• interfere with the Service’s operation or attempt to access accounts or data that are not yours.

We may suspend or terminate access for violations of these Terms.

6. Third-party services

The Service depends on Meta’s platforms and APIs, which we do not control. We are not affiliated with Meta, and we are not responsible for changes to, or unavailability of, Meta’s services.

7. Privacy

Our Privacy Policy describes what information we collect and how we use and protect it, and our Data Deletion page describes how to have your data deleted.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that publishes will succeed, that the Service will be uninterrupted, or that it will remain compatible with Meta’s platforms.

9. Limitation of liability

To the maximum extent permitted by law, ZIKLAG HOLDINGS, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim or one hundred U.S. dollars (USD 100).

10. Termination

You may stop using the Service at any time; disconnecting your accounts and requesting deletion is described on our Data Deletion page. We may suspend or terminate the Service or your access to it with reasonable notice where practicable.

11. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the effective date above; material changes will be notified on our website. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.
